The terms governing use of winnen.ai
These Terms of Service ("Terms") govern your access to and use of the winnen.ai website and web application (the "Service") provided by Winnen Gesellschaft für Elektro- und Kommunikationstechnik mbH ("winnen.ai", "we", "us"). By creating an account or using the Service, you agree to these Terms.
winnen.ai is a web-based software platform that helps electrical contractors and property teams document E-Check and DGUV V3 safety inspections, generate reports, manage assets and track re-test deadlines, supported by AI features. The Service is provided as software only.
You must provide accurate registration information and are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. The Service is intended for business (B2B) use by professionals.
winnen.ai assists with documentation, classification and reminders. It does not perform inspections and does not replace the qualified person ("befähigte Person" / qualified electrician) who carries out and signs off each inspection. Responsibility for the correctness of measurements, assessments and legal compliance remains with the user and the qualified person.
Paid plans are billed in advance on a recurring basis according to the plan you select. Fees are stated exclusive of applicable VAT unless otherwise indicated. Unless required by law, fees already paid are non-refundable.
We aim to provide a reliable Service but do not warrant uninterrupted or error-free availability. We may perform maintenance and update or modify features from time to time.
To the extent permitted by law, winnen.ai is liable without limitation only for intent and gross negligence, and for injury to life, body or health. In cases of slight negligence, we are liable only for breaches of essential contractual obligations, limited to the foreseeable, typical damage. Any further liability is excluded.
Subscriptions run for the period selected and may be terminated in accordance with the plan terms. We may suspend or terminate access for material breach of these Terms.
These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. Where permitted, the place of jurisdiction is Aachen, Germany.
We may update these Terms from time to time. We will notify you of material changes, and continued use of the Service after changes take effect constitutes acceptance.
